Maybe they should let Mamdani try to arrest Netanyahu. Then the Trump Administration could arrest and prosecute Mamdani.

Very troubling. It all happened so quickly. But why? Why did this happen at all. Newyorkers seem to applaud to a second september 11. How could the Muslim Brothers have progressed so rapidly? Qatar’s money?

Informative essay, very helpful in understanding the law and motivation for Mamdani's statements. I'm assuming if Tisch remains NYPD Commissioner she would instruct officers not to arrest Netanyahu based on the ICC warrants and she would be fired. NYPD officers faced with possible arrest by federal agents might be hesitant to make such an arrest absent a state warrant. In the federal system the feds can act upon arrest warrants issued by foreign nations through a process called Letters Rogatory. State officers cannot rely upon such a process, and besides, the ICC wouldn't have the authority to request such. As you noted, Mamdani's statement is made to gain votes among the anti-semites that otherwise would find positions of Mamdani untenable.

The Fed government may be able to act on warrants by foreign nations in general, and as you correctly point out, states and cities cannot. But as we explained in the post, US law prohibits even the Federal govt from acting on warrants specifically from the ICC. (It’s actually legally possible for the White House to make an official exception but not for a mayor to do so under the ASPA)

Here’s an interesting thought experiment:

If someone were to assassinate Mamdani based on the belief that he is “hateful” and “spreading hate”, would the progressive media and politicians agree that such an action is justified, as they are doing with the murder of Charlie Kirk?

Obviously we don't support killing public officials no matter how wrong they are, but we do support having a national conversation that's actually sane, one in which nobody supports calls for assassination, which is what I think you were getting at.
